Home Page Settlements Brian Hallock, a former employee of McCormick Foods, has been awarded $5.4 million in settlement of his personal injury lawsuit, which he brought against Polarome International, Inc., a chemical manufacturer and distributor. In his suit, Hallock alleged that Polarome failed to properly warn of the dangers of exposure to large doses of the chemical, despite federal health warnings. Hallock alleged that during the course of his employment for a manufacturer of various food flavorings and food products, he was exposed to a chemical called diacetyl. He began experiencing shortness of breath, difficulty breathing and reduced lung capacity, and was subsequently diagnosed with bronchiolitis obliterans (popcorn lung) in 2006. Hallock suffered from severely depleted lung capacity. Although Polarome denied the allegations, the jury found in Hallock’s favor and awarded the multi-million dollar settlement, which was subject to Maryland’s statutory cap on non-economic damages.
